NFARS Network – Terms and Conditions
1. Introduction
Welcome to NFARS Network, located at 1036 Main Street, Palmer, TN, 37365 (“NFARS,” “NFARS.org,” “we,” “us,” or “our”). By accessing or using our website, NFARS.org, or engaging with our services and resources in any capacity, you agree to comply with and be bound by these Terms and Conditions. If you do not agree, please refrain from using our services.
By using our membership checkout portal and completing the steps necessary to provide payment for your NFARS Network membership, you acknowledge that you have read and agreed to these Terms and Conditions.
These terms apply to both online use of NFARS.org and interactions within the NFARS Network or our brick-and-mortar locations or other real-world engagements. The one-time membership fee to join the NFARS Network is $150.00.
2. Membership Eligibility
You must be at least 18 years old to join NFARS Network. By joining, you confirm that you are legally able to enter into this agreement.
3. Online Use and Network Interactions
3.1. Online Use
You agree to use NFARS.org and the entire NFARS Network only for lawful purposes and in compliance with these terms.
You will not engage in activities that could harm the functionality, security, or reputation of our website or outside real-world network or any members of the Network.
3.2. Network Interactions
You agree to conduct yourself professionally when interacting with other members or using the NFARS Network for business purposes. You acknowledge that any unethical or illegal activity conducted within the network may result in immediate termination of membership.
4. Membership Responsibilities
Members are responsible for conducting their own business and ensuring they follow all applicable laws and regulations when using the resources and services of NFARS Network. This includes, but is not limited to, using NFARS materials in compliance with relevant state, federal, and local laws.
5. Limitations of Liability
Working or conducting business in the repossession, recovery, marketing, debt collection, inspection, cleanup, and process serving industries can be dangerous and may carry financial liabilities. All NFARS members are independent contractors, operating within their own entity or business model. Under no circumstances is NFARS or any part of the NFARS Network responsible or liable for any harm, loss, or damages incurred by any member or other party working for a member or a member’s business.
Furthermore, the NFARS Network is not responsible for any damages that a third party, doing business with an NFARS member, may incur. All forms and materials provided to members should be used within the framework of all state and federal laws. Members should consult a professional attorney to review all materials provided by NFARS before using them to conduct business.
6. Confidentiality and Non-Disclosure Agreement
Members agree not to disclose any confidential information about the NFARS Network, its operations, or any proprietary resources to unauthorized third parties. This obligation of confidentiality remains in effect even after termination of membership.
Members further agree to use information, resources, and materials provided by NFARS solely for the purpose of conducting business within the scope of the Network and not to share these resources outside the Network without express written consent from NFARS.
7. Non-Competition Agreement
Members agree not to directly or indirectly start or operate any business that competes with the NFARS Network within the United States of America. This non-competition clause is in effect for a period of five (5) years after the termination of membership. This includes, but is not limited to, marketing services, auction platforms, and any other business practices associated with NFARS.
8. Payment Terms
8.1. Membership Fees
The one-time membership fee to join the NFARS Network is $150.00. Membership fees are required for the use of NFARS Network services, including access to our website and real-world resources. By completing the membership checkout process and paying the required fee, you agree to the terms and conditions outlined in this agreement.
8.2. Refund Policy
NFARS does not offer refunds unless we have misrepresented our services or provided inaccurate information regarding membership benefits. In the event that a refund is requested and approved, the original membership certificate must be returned to NFARS before the refund is processed. The membership certificate is transferable to another individual, and if a member wishes to transfer their membership to someone else, they may do so in accordance with the guidelines set by NFARS.
8.3. Revenue Sharing and Member Earnings
8.3.1. Member Earnings
When members of the NFARS Network contract with banks, financial institutions, or other clients, 100% of the revenue generated from these contracts is the sole property of the member. NFARS does not claim or take any percentage of these contract earnings. Members are free to retain all funds earned from their independent business activities while engaging with these entities.
8.3.2. Revenue Sharing for Marketing and Auction Services
Members who use RamAuction.com or any other marketing service provided by NFARS, as part of their service to the financial institutions they contract with, will share in the revenue generated from the marketing efforts. NFARS will bill the bank or financial institution directly for the marketing service. After NFARS collects the payment for the marketing services, 50% of the total revenue will be shared with the member who used the marketing service for the asset. The remaining 50% will be retained by NFARS for providing the marketing and auction services.
8.3.3. Initial Signup Fee Reimbursement
To further support members in the early stages of their business, NFARS will reimburse the full membership signup fee of $150 upon a member’s first use of RamAuction.com or another marketing service provided by NFARS. This reimbursement is contingent upon the member completing their first marketing or auction transaction through one of the NFARS-approved services.
9. Member Conduct and Restrictions
Members agree not to use the NFARS Network or resources for any unlawful or unethical purposes. Members are prohibited from attempting to undermine, disrupt, or damage the NFARS website, auction platform, marketing services, or any other aspect of the NFARS Network.
10. Termination of Membership
NFARS reserves the right to terminate any membership for violating the Terms and Conditions of this agreement. If membership is terminated for any reason, the member will not be entitled to a refund.
11. Amendments
NFARS reserves the right to modify these Terms and Conditions at any time. Any amendments will be communicated to members, and continued use of the services after changes are made constitutes acceptance of the new terms.
12. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Grundy County, Tennessee, United States.
13. Miscellaneous
- These Terms and Conditions constitute the entire agreement between the parties.
- Any amendments to these terms must be in writing and signed by authorized representatives of NFARS.
